Best Practices for Constitutionally Balancing Free Speech & Order at School Board Meetings
This presentation will explore the public forum doctrine and its application to public comment periods at school board meetings. The speakers will examine the constitutional requirements of reasonableness and viewpoint neutrality and review common regulatory approaches used by public bodies. The discussion will distinguish permissible time, place, and manner restrictions and germane-topic requirements from restrictions that courts have found to be constitutionally unreasonable or viewpoint based.
