The Fiduciary Law Section has as its primary goal the improvement of skills of lawyers who practice in the fiduciary area by sponsoring seminars such as the Fiduciary Law Seminar, the Estate Planning Institute in Athens, the Basic Estate Planning Seminar and other programs. In addition, the Section monitors legislation in the fiduciary area; helps in drafting fiduciary legislation and works with the probate judges to improve the administration of justice and seeks to maintain high standards of professionalism and a strong sense of collegiality among the Section members.

Developments in Georgia Fiduciary Law
The following annual summaries of developments in Georgia fiduciary law were prepared by Professor Mary F. Radford, Georgia State University College of Law, Atlanta, Georgia. They are available as PDF files.
These are large portable document format (pdf) file and make take some time to download depending on your connection speed.
Note: These summaries are offered as an aid to maintaining professional competence with the understanding that neither the author nor the Fiduciary Law Section are rendering legal or other professional advice.
Flexible Income Trust Committee Issues Report
The Fiduciary Law Section created a committee chaired by Donna Barwick to study whether Georgia should adopt one of the legislative approaches to total return or flexible income trusts that some other states have been adopting. The Committee has completed its work, and on July 10, 2002, issued a report containing proposed amendments and revisions to the Georgia Trust Act. The Committee's proposed legislation has been recommended by the Section's Legislation Committee, and the Executive Committee is currently considering the report.
Since the Committee's report was received after this year's unusually early deadline for submitting bills to the Advisory Committee on Legislation of the State Bar for its September meeting, there is time for study. The comments of Section members are invited on this important proposal. Please contact Donna Barwick at (404) 231-2340.
