Maximizing the Effectiveness of Mandatory Pre-Litigation Mediation in Franchise Disputes.

Many franchise agreements attempt to achieve early resolution of disputes between the parties by requiring mandatory mediation of all or some disputes before a party may initiate formal legal action in court or arbitration. This one-hour CLE program will focus on practical tips from the practitioner and mediator perspectives for conducting mandatory pre-litigation mediations, including:

  • The benefits of mandatory early mediation;
  • Franchise-specific issues that can arise in early mediations;
  • Enforcement of mandatory mediation contract provisions;
  • Challenges for conducting early mediations; and
  • Specific considerations for conducting virtual mediations.
