Flexible Income Trust Committee Issues Report

The Fiduciary Law Section created a committee chaired by Donna Barwick to study whether Georgia should adopt one of the legislative approaches to total return or flexible income trusts that some other states have been adopting. The Committee has completed its work, and on July 10, 2002, issued a report containing proposed amendments and revisions to the Georgia Trust Act. The Committee's proposed legislation has been recommended by the Section's Legislation Committee, and the Executive Committee is currently considering the report.

Since the Committee's report was received after this year's unusually early deadline for submitting bills to the Advisory Committee on Legislation of the State Bar for its September meeting, there is time for study.
